THE TERMS AND CONDITIONS OF SALE ("TERMS OF SALE") SET OUT BELOW ARE APPLICABLE TO ONLINE PURCHASES FROM THIS WEBSITE. PLEASE READ THEM CAREFULLY AS THEY AFFECT YOUR LEGAL RIGHTS AND LIABILITIES AND SET OUT THE TERMS UNDER WHICH IQ INNOVATIONS LIMITED MAKES GOODS AVAILABLE TO YOU. WE RECOMMEND THAT YOU PRINT AND RETAIN A COPY OF THESE TERMS OF SALE FOR FUTURE REFERENCE.

PLEASE NOTE THAT GOODS DISPLAYED ON THIS SITE ARE ONLY AVAILABLE FOR DELIVERY WITHIN THE UK.
In these Terms of Sale, references to "we", "us" or "our" means IQ Innovations Limited.
YOUR STATUTORY RIGHTS ARE NOT AFFECTED BY THESE TERMS OF SALE.
1. The Contract Between Us
1.1
You may submit your order to us either by telephone or by completing and submitting the online order form. The price of your purchase (including delivery charges) will be debited from your debit or credit card when you submit your order. Once your order has been received by us you will receive an e-mail confirming that your order has been received and is being processed. However, no contract of any kind will exist between you and us unless and until we dispatch the goods to you. Until that point we reserve the right to refuse to supply your order in accordance with clause 4.2(a) below and if we do so, the price of your purchase will be re-credited to you in accordance with clause 4.2(b).
2. Price
2.1
The prices payable for goods that you order are as set out in the Site. All prices are in pounds sterling and inclusive of VAT and delivery in the United Kingdom unless otherwise stated.
3. Availability
3.1
All goods are subject to availability. If for any reason beyond our reasonable control we are unable to supply a particular item we will notify you as soon as possible and may offer to supply you with substitute goods of an equivalent price and quality.
4. Cancellation and Refund Policy
4.1
Cancellation by you (a) Provided that the original packaging and all components originally sold with the goods are intact, you may cancel your contract with us for the goods you order within 7 working days after the date you receive the ordered goods. You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty. (c) If the goods have already been dispatched to you at the date of receipt of your cancellation of the order you must return the goods to our contact address at your own cost and risk, together with a note stating your name, date of order and order number. We cannot be responsible for non-delivery of returned goods and recommend that you get a certificate of posting from the Post Office.
(d) Once you have notified us that you are cancelling your contract, your debit or credit card will be credited with the price of the goods as soon as possible and in any event within 30 days of your cancellation PROVIDED THAT the goods in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you or do not pay the costs of delivery, we shall be entitled to deduct the direct cost of recovering the goods from the amount to be re-credited to you.
(e) If goods are returned you will be refunded the cost of the goods but not your costs in returning the goods.
(f) Your statutory rights are not affected.
4.2
Cancellation by us (a) We reserve the right to cancel your order if: (i) we have insufficient stock to deliver the goods you have ordered;
(ii) you have ordered goods for delivery outside the United Kingdom; or
(iii) one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
(b) If we cancel your order we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit or debit card as soon as possible but in any event within 30 days of your order. We will not be obliged to pay any additional compensation for disappointment or other loss suffered.
5. Delivery
5.1
Delivery of the goods will be to the UK address specified by you when you place your order and, accordingly, we will not be responsible for goods not received due to you supplying incorrect delivery details.
5.2
We only deliver within the United Kingdom.
5.3
Delivery will be made as soon as possible after your order is accepted and in any event within 30 days of your order. However, we shall not be liable for loss caused by delay in delivery arising out of any reason beyond our control.
6. Payment Methods
6.1
Payment may be made via our Site or over the telephone, using any major debit or credit card and the payment transaction will be handled on our behalf by our payment agent (which shall be Sage Pay) on their secure server.
6.2
All payment amounts will be stated and taken in pounds sterling only.
7. Liability
7.1
We accept no liability (to the fullest extent permitted by law) for the accuracy of information on the Site, which may contain technical inaccuracies or typographical errors.
7.2
Our liability to you in connection with any order will not exceed the total price charged for the relevant goods and, save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under these Terms of Sale.
7.3
Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
7.4
We shall have no liability to you for any failure to deliver goods you have ordered or any delay in delivery or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, acts of God, war, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire explosion or accident.
8. Privacy
8.1
You acknowledge and agree to be bound by the terms of our Privacy Policy.
9. General
9.1
These Terms of Sale, together with our current Site prices, delivery details, contact details, Terms of Use and Privacy Policy, set out the whole of our agreement relating to the supply of the goods to you by us. No variation of these shall be valid unless in writing and signed by a director of IQ Innovations Limited.
9.2
If any part of these Terms of Sale is found to be unenforceable, the enforceability of the remaining provisions of these Terms of Sale will not be affected.
9.3
A person who is not a party to the contract between us has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the contract but this does not affect any right or remedy of a third party that exists or is available apart from that Act.
9.4
These Terms of Sale and the contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have exclusive jurisdiction to resolve any disputes between us.
